EMPLOYEE co-determination

The term co-determination relates to the way in which employees are involved in the establishment of important policy decisions by the business. Depending on the size of the organisation, this may take the form of a Works Council, workers’ representation body or a town-hall meeting. Certainly there are combinations and overarching forms of employee representation, if for example a business is part of a group of companies or if part of the co-determination process takes place at an international level.

VDB Advocaten Notarissen regularly advise entrepreneurs and Works Councils on the structure for employee co-determination and the relevant procedures prior to important policy decisions. These include the establishment and amendment of employment conditions, reorganisations, restructurings , refinancing, mergers and acquisitions. Other integral elements include initiating legal proceedings and negotiating with trade unions.
